Official Rules
1. NO PURCHASE NECESSARY TO ENTER OR WIN
The Hyatt Regency Newport Beach Summer Concert Series Sweepstakes (the “Sweepstakes”) is open to legal residents of the State of California ONLY, who are at least 21 years of age as of date of entry. Void outside California and where prohibited by law. If you are not a resident of California, do NOT attempt to enter the Sweepstakes as it is not intended for you. Employees, officers, directors of Newport Beach & Company (“Sponsor”), Hyatt Regency Newport Beach Summer Concert Series (including Hyatt Hotels Corporation and advertising partners of the 2015 Hyatt Regency Newport Beach Summer Concert Series), prize suppliers, and advertising and promotion agencies and the immediate family members (parents, children, siblings, spouse) and those living in the same household of each, are not eligible to participate in this Sweepstakes. (For the avoidance of doubt, volunteers at the 2015 Hyatt Regency Newport Beach Summer Concert Series ARE eligible to enter the Sweepstakes.) All federal, state and local laws and regulations apply.
The Hyatt Regency Newport Beach Summer Concert Series Sweepstakes begins on/about 12:00 a.m. Pacific Time (PT) June 15, 2015 and ends 11:59 p.m. PT June 21, 2015 (“Promotional Period”).
2. PRIZE
One (1) Grand Prize package consisting of: 3-days/2-nights hotel (standard, double occupancy and room tax only) accommodations at the Hyatt Regency Newport Beach hotel (arrival on Friday, 6/26/15 and departure on Sunday, 6/28/15), two (2) tickets to the “Evening with Kenny G” concert of the 2015 Hyatt Regency Newport Beach Summer Concert Series taking place at the Hyatt Regency Newport Beach hotel on June 26, one (1) dinner certificate for two at the Red O restaurant (value of $200.00; subject to terms/conditions of use as indicated thereon) at Newport Beach and two (2) Admiral passes good towards a Hornblower Cruises & Events dining cruise (value of $140.00; subject to terms/conditions of use as indicated thereon) Grand Prize is valid June 26-28, 2015 so as to attend the “Evening with Kenny G” concert at the 2015 Hyatt Regency Newport Beach Summer Concert Series; if winner is not available at such time for any reason, Grand Prize will be forfeited in its entirety and an alternate winner will be selected, time permitting. (For the avoidance of doubt, winner will only receive tickets to the “Evening with Kenny G” concert but not any other concerts that are part of the 2015 Hyatt Regency Newport Beach Summer Concert Series.) Prize is subject to availability and additional restrictions. Prize must be accepted in its entirety or not at all. Grand Prize Winner is solely responsible for any and all costs and expenses not expressly specified in these Official Rules including, but not limited to, travel to/from Newport Beach, parking at Hotel, incidentals, gratuities, personal charges incurred in conjunction with acceptance/use of prize package; security fees, taxes or all other unspecified expenses are the responsibility solely of the winner. Tickets to the Evening with Kenny G concert are subject to terms and conditions as indicated thereon; seat location to be determined in Sponsor’s sole discretion. Should winner choose to accept prize (in whole or in part) without a guest, Grand Prize will be awarded in increments (as applicable) appropriate for one (1) person – the winner him/herself – and no substitute or alternate prize will be awarded. Guest must be at least 21 years of age. Grand Prize Winner will be solely responsible for applicable federal and state taxes on prize; winner will be issued an IRS 1099 Tax Form reflecting the fair market value of the Grand Prize and agrees to fully cooperate with Sponsor in its fulfillment of its corresponding tax reporting obligation. Total Approx. Retail Value of Grand Prize: $950
Subject to all applicable federal and state laws. No substitution, cash redemption, assignment or transfer of prize permitted but the Sponsor reserves the right to substitute a prize of equal or greater value in the event that the offered prize is unavailable (in whole or in part) for any reason.
3. HOW TO ENTER
During the Promotional Period, to enter go to https://www.visitnewportbeach.com/ktla/ and follow the instructions and complete and submit your online entry (name, phone where you may be reached if your entry is selected in drawing, email and zip code). You will receive one (1) entry into the Grand Prize drawing. All entries must be received by 11:59 p.m. PT June 21, 2015.
Any other attempted form of entry is void and will not be accepted. Entrant must be the registered and authorized account holder of the e-mail account through which the entry is made. “Authorized account holder” is defined as the natural person who is assigned to an e-mail address by an internet service provider, or other organization (e.g., business, educational institution) that is responsible for assigning e-mail addresses for the domain associated with the submitted e-mail address. In the event of a dispute as to ownership of an entry, entrant may be required to provide proof of ownership of the e-mail account used to enter the Sweepstakes. Entry may not be made by proxy or automated means such as by script, bot, macro or any other similar software or program.
Limit one (1) entry per person or email address per day. If more than one (1) entry is received from the same person or email address for a given day, Sponsor will accept only the first entry received and will deem to be void all such additional entries. Repeated or egregious violations of the entry limit, as determined by Sponsor in its sole discretion, will result in disqualification from Sweepstakes. Sponsor is not responsible for lost, late, incomplete, invalid, unintelligible/garbled, corrupted, inaccessible or misdirected entries, which are void and will be disqualified.
Odds of winning the Grand Prize depend on the total number of eligible entries received during the entire Promotional Period.
Participation in Sweepstakes constitutes permission from Entrant for Sponsor and its agencies to use Entrant’s name (first and last), voice, likeness and/or other indicia of persona without notice or compensation for purposes of advertising and trade, unless prohibited by law. Further, participation includes the right to post Winner’s first name, last initial and city of residence on the Visit Newport Beach website https://www.visitnewportbeach.com/ktla/ and/or the Visit Newport Beach social media sites, including the Visit Newport Beach Facebook page, the Visit Newport Beach Twitter page and the Visit Newport Beach Instagram page, unless prohibited by law.
4. WINNER SELECTION/RANDOM DRAWING
Grand Prize winner will be selected in a random drawing on or about June 22, 2015. Grand Prize drawing will consist of all eligible entries received during the entire Promotional Period. The decisions of Sponsor and Administrator are final and binding on all matters relating to this Sweepstakes. Potential Grand Prize Winner will be notified via phone following drawing. If the Potential Grand Prize winner cannot be contacted, such potential winner will be disqualified and an alternate winner will be selected, time permitting.
Grand Prize winner must prove eligibility. Grand Prize Winner will be required to sign and return within six (6) hours of notification: (1) a release relieving Sponsor, Administrator, Hyatt Regency Newport Beach Summer Concert Series (including Hyatt Hotels Corporation), prize suppliers and their agencies from any liability, claims, demands and cause of action for personal injury or death, and/or damage, theft, or loss suffered in connection with this Sweepstakes or the acceptance, receipt, possession, use and/or misuse of the prize or any portion thereof; and where permitted by law, granting Sponsor and its designees (including Hyatt Regency Newport Beach Summer Concert Series/Hyatt Hotels Corporation) the right to use the winner’s name, voice and likeness for advertising, trade and publicity purposes without additional compensation or further notice; (2) an affidavit of (winner’s) eligibility and full compliance with these Official Rules; and (3) other legal documents which the Sponsor may require. Noncompliance with this requirement (failure to timely complete, sign and return the required documents) or inability of Sponsor to contact potential winner will result in forfeiture of the prize without compensation of any kind and an alternate Prize Winner will be selected from all remaining eligible entries received, time permitting. Any attempt to defraud Sponsor or Administrator in any way will result in disqualification of participant; and, such participant may be prosecuted to the fullest extent of the law.
5. INTERNET
Sponsor’s computer will be the official clock for the Sweepstakes. Sponsor, Hyatt Regency Newport Beach Summer Concert Series (including Hyatt Hotels Corporation), their respective parent companies, subsidiaries, and affiliates, prize suppliers, and their respective advertising, promotion or production agencies are not responsible for technical, hardware, software or telecommunications malfunctions of any kind, lost or unavailable network connections, or failed, incorrect, incomplete, inaccurate, garbled or delayed electronic communications caused by the sender, or by any of the equipment or programming associated with or utilized in this Sweepstakes which may limit the ability to participate (including but not limited to defects/errors/malfunctions), or by any error which may occur in the entry process or the Sweepstakes. Without limiting the foregoing, Sponsor is not responsible for electronic communications/emails not received due to email filtering, virus protection or other protective devices/apparatus or any other cause.
CAUTION: ANY ATTEMPT BY AN ENTRANT TO DELIBERATELY DAMAGE ANY WEBSITE OR UNDERMINE THE LEGITIMATE OPERATION OF THE SWEEPSTAKES IS A VIOLATION OF CRIMINAL AND CIVIL LAW. SHOULD SUCH AN ATTEMPT BE MADE, SPONSOR RESERVES THE RIGHT TO SEEK DAMAGES FROM ANY SUCH INDIVIDUAL TO THE FULLEST EXTENT OF THE LAW (AND TO DISQUALIFY SUCH INDIVIDUAL FROM THE SWEEPSTAKES IF APPLICABLE). If for any reason (including, but not limited to, infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures, or any other cause beyond the control of Sponsor, which corrupts or affects the administration, security, fairness, integrity, or proper conduct of this Sweepstakes and renders the Sweepstakes incapable of being conducted as described in these Official Rules), Sponsor shall have the right, at its sole discretion, to cancel, terminate, modify or suspend the Sweepstakes in whole or in part. In such event, Sponsor shall make the Grand Prize available to be won by selecting from among all eligible entries received prior to the action taken by Sponsor or otherwise make the Grand Prize available in a manner, determined by Sponsor in its sole discretion, to be fair, appropriate and consistent with the spirit of these Official Rules. Notice of such action by Sponsor will be posted at https://www.visitnewportbeach.com/ktla/
6. GENERAL RULES
By entering the sweepstakes, Entrant agrees to be bound by these Official Rules and all decisions of Sponsor which are final and binding in all respects; and to release Sponsor, Administrator, The Hyatt Regency Newport Beach Summer Concert Series, Hyatt Hotels Corporation, Red O Restaurants, Hornblower Cruises & Events and (as applicable) each of their respective parent companies, subsidiaries, affiliates, directors, officers, agents, attorneys, employees and other parties, Facebook, Twitter, Instagram, and Kenny G, from any and all liability whatsoever for any claims, costs, injuries, losses or damages of any kind (including, without limitation, related to personal injury, death, damage to property, infringement of proprietary rights, rights of publicity or privacy or defamation) and attorney fees, whether or not in connection with litigation, including, but not limited to, any harm or loss caused by, contributed to, arising out of or related to Entrant’s participation in this Sweepstakes or the acceptance, possession, receipt, use/misuse of the Prize or any component thereof (if applicable).
The Sweepstakes is governed by the laws of the State of California (excluding its principles of conflicts of laws/choice of laws), with venue in Orange County and all claims must be resolved individually (NOT PART OF A CLASS) in the appropriate state and federal courts of Orange County. By participating, you agree to the exclusive jurisdiction of such courts. Sponsor’s failure to enforce any provision of these Official Rules shall not constitute the waiver of such provision.
